This notice explains how health information about you may be used and disclosed, how you can access your information, and the responsibilities of Strategic Spine Management & Chiropractic regarding your protected health information.
Your Rights
You have the right to:
Get a copy of your health record. You may ask to see or receive an electronic or paper copy of your medical record and other health information we maintain about you. We will provide access as required by applicable law.
Ask us to correct your health record. You may ask us to correct information that you believe is incorrect or incomplete. We may deny the request in certain circumstances, but we will explain the reason in writing when required.
Request confidential communications. You may ask us to contact you in a specific way or at a specific location. We will accommodate reasonable requests.
Ask us to limit what we use or share. You may request restrictions on certain uses or disclosures of your health information. We are not always required to agree, except when applicable law requires us to do so.
Receive an accounting of disclosures. You may request a list of certain disclosures of your health information made during the period allowed by law.
Receive a copy of this notice. You may request a paper or electronic copy of this notice at any time.
Choose someone to act for you. If you have given someone medical power of attorney or another person has legal authority to act for you, that person may exercise your privacy rights as permitted by law.
File a complaint. You may complain to us if you believe your privacy rights have been violated. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.
Your Choices
In certain situations, you may tell us your preferences regarding how we share your information, including sharing information with family members or others involved in your care.
We will obtain your written authorization when required by law for uses or disclosures such as certain marketing activities, the sale of protected health information, or other uses not otherwise permitted by law. You may revoke an authorization in writing as permitted by law.
How We May Use and Share Your Information
We may use or disclose your health information for purposes permitted or required by law, including:
Treatment. We may use your information to provide, coordinate, or manage your care and may share appropriate information with other health professionals involved in your treatment.
Health care operations. We may use your information to operate our practice, manage services, evaluate quality, train staff, and conduct other lawful health care operations.
Payment. We may use or disclose information as necessary to bill and obtain payment for services, including communications with health plans or other responsible payers when applicable.
Public health and safety. We may disclose information when permitted or required for activities such as preventing disease, reporting certain injuries or conditions, reporting suspected abuse or neglect, or preventing a serious threat to health or safety.
Health oversight and legal requirements. We may disclose information to authorized government or oversight agencies and when otherwise required by federal or state law.
Workers’ compensation. We may disclose health information as authorized or required by workers’ compensation laws and similar programs.
Law enforcement and government requests. We may disclose information when permitted or required by law in response to qualifying law-enforcement, governmental, military, national-security, or correctional requests.
Judicial and administrative proceedings. We may disclose information in response to a valid court or administrative order, subpoena, discovery request, or other lawful process, subject to applicable privacy protections.
Research. Health information may be used or disclosed for research when the requirements of applicable privacy law have been satisfied.
Organ donation, medical examiners, and funeral directors. We may disclose information when permitted by law for organ or tissue donation or to coroners, medical examiners, or funeral directors.
Specially Protected Information
Some health information may receive additional protection under federal or Texas law. When another law provides greater privacy protection than HIPAA, we will follow the more protective requirement.
To the extent that we create, receive, or maintain substance use disorder patient records that are protected by 42 CFR Part 2, those records receive additional federal confidentiality protections. Such records generally may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against a patient unless the requirements of applicable federal law are satisfied, including when required, the patient’s written consent or an appropriate court order and subpoena.
Texas law also provides privacy protections for protected health information, and certain categories of information may be subject to additional confidentiality requirements. We will comply with applicable Texas and federal law.
Our Responsibilities
We are required by law to maintain the privacy and security of protected health information.
We will notify affected individuals as required by law if a breach occurs that may have compromised the privacy or security of their information.
We must follow the privacy practices described in the notice currently in effect.
We will not use or disclose your information in ways not described in this notice unless you authorize us to do so or the law otherwise permits or requires the use or disclosure.
Changes to This Notice
We may change the terms of this notice and make the revised notice effective for health information we already maintain as well as information we receive in the future. The current notice will be available upon request, at our office, and on our website.
